This policy states what DIGIT DECK AGENCY S.A.S. (“Digitdeck”) promises when it says “We work for free until we make it happen”: which services it applies to, what “free” means, what “making it happen” means and how to request it. Each capitalized term is defined the first time it appears. The policy is published in Spanish and in English, and both versions have equal authority.

Summary

1. Purpose and covered services

1.1. This policy governs the commercial guarantee “We work for free until we make it happen” (the “Guarantee”), which Digitdeck offers voluntarily.

1.2. The Guarantee applies to projects to build a Shopify theme that Digitdeck quotes as “Página completa” (full site) or “Landing page” (each one, a “Project”). The “Client” is the person or company that hires the Project.

1.3. The “Quote” is the written document, signed or accepted by the Client, that sets the pages, templates and features of the Project (the “Scope”), its price and its schedule.

1.4. The Guarantee does not apply to “Optimización recurrente” (recurring optimization). It is a monthly service and has no end point to reach: it is delivered and billed according to the monthly deliverables of its Quote.

1.5. The Guarantee does not apply to any other service or work either, unless the Quote expressly says it covers it.

2. What “free” means

2.1. The Client pays the Project price shown in the Quote.

2.2. “Free” means Digitdeck charges no additional amount for the extra work, adjustments and review rounds needed for the Project to meet the Criteria, within the Scope.

2.3. The Guarantee is not a refund: it does not return or reduce the price paid. Any refund is governed by the Quote and by law.

2.4. The Guarantee does not promise business results: not sales, not conversion, not traffic, not search-engine ranking, and not a particular performance score.

2.5. The Guarantee does not make the Project free of charge and does not cover work outside the Scope (section 6).

2.6. The Guarantee is in addition to the rights the law gives the Client and does not replace or limit them, including those of the Consumer Statute (Law 1480 of 2011) where they apply to the Client.

3. What “making it happen” means

3.1. “Making it happen” occurs when all of the following criteria are met (the “Criteria”). They are objective: they are checked against documents and against the built theme, not against a later preference.

  • (a) Approved design. Each page and each template in the Scope has its design, for mobile and for desktop, and the Client approved it in writing before construction began (the “Approved Design”).
  • (b) Theme faithful to the design. The Shopify theme (the “Theme”) includes every page and template in the Scope and is faithful to the Approved Design. It is compared side by side at a mobile width of 390 px and a desktop width of 1440 px. There is a difference when an element is missing, when its order, text or image changes against the Approved Design and the content the Client provided, or when something overflows or becomes unreadable.
  • (c) Editable. The Client can add, reorder and edit the content of the pages and templates in the Scope from the Shopify theme editor, using sections and blocks, without touching code. Anything the Quote marks as fixed is excepted.
  • (d) Functional, with no blocking errors. Navigation, the cart, the handoff to the Shopify checkout and the Theme’s forms that are part of the Scope work. An error is blocking when it prevents reading a page, adding a product to the cart, reaching the checkout or submitting a form.
  • (e) Delivered for review. Digitdeck delivers the Theme on a Shopify preview theme, which is not published, with an access link and a checklist of Criteria (a) to (d), so the Client can run the acceptance review (“Acceptance QA”).

3.2. When Criteria (a) to (e) are met and the Client confirms it under section 4.7 or 5.5, it is understood that it was made to happen.

3.3. After the Approved Design, a change of taste, style or content is not a correction: it is a change of Scope (section 6.1). A correction is what brings the Theme back to the Criteria.

3.4. No Criterion is a figure for sales, conversion, traffic, search-engine position or performance score.

4. Procedure

4.1. Brief and Quote. Digitdeck and the Client agree in writing on the Scope, the price and the schedule.

4.2. Design and approval. Digitdeck presents the design of all pages and templates in the Scope. Adjustments the Client asks for on the design before approving it are part of this stage and carry no additional charge. Construction does not begin without an Approved Design.

4.3. Build. Digitdeck builds the Theme from the Approved Design and the Client’s inputs.

4.4. Delivery for Acceptance QA. Digitdeck delivers the Theme under Criterion (e) and gives written notice.

4.5. Observations. The Client reviews the Theme and sends a written list of observations. Each observation states the page or template, what is seen and what was expected according to the Approved Design or the Criteria; a screenshot or a link helps. The Client gathers in each list everything it finds.

4.6. Correction rounds at no additional charge. Digitdeck reviews each observation. It corrects, at no additional charge, every observation that shows a Criterion is not met and delivers the corrected Theme for a new review. To an observation that does not correspond to a Criterion it replies in writing and explains why: it is a change of Scope and is quoted separately (section 6). The rounds repeat until the Criteria are met. There is no maximum number of rounds.

4.7. Written acceptance. When the Criteria are met, the Client confirms in writing, by email or by message on the agreed channel, that it accepts the Theme (“Acceptance”).

4.8. Disagreement. If the Client considers that a Criterion is not met and Digitdeck considers that it is, Digitdeck shows the check: the comparison with the Approved Design and the checklist. What is not resolved this way is governed by the Quote and by applicable law.

5. Deadlines and Client obligations

5.1. Inputs. The Client provides the texts, images, logos, catalog and access the Project needs. It provides them by the deadline set in the Quote or, if none is set, within 5 business days after Digitdeck’s written request.

5.2. Schedule. If the Client is late, the schedule moves by the same amount of time.

5.3. Contact person. The Client designates the person who approves and receives notices for the Project.

5.4. Response to each delivery. The Client has 5 business days from each delivery to send its list of observations or its Acceptance. The period starts again with each corrected Theme.

5.5. Acceptance by silence. If 10 business days pass after a delivery with no response, Digitdeck sends a written reminder. If 15 business days pass after that delivery with no observations or response, or if the Client publishes the Theme on its store, the Client is deemed to have accepted the Theme and the Criteria are deemed met.

5.6. Business days. They are Monday to Friday, except Colombian public holidays.

6. Exclusions

The Guarantee does not cover, and Digitdeck quotes separately, the following:

6.1. Changes of Scope. New pages, templates or features, and changes of design, style or content after the Approved Design.

6.2. Third parties and platform. Third-party apps and services, and outages, changes and technical limitations of Shopify or of those third parties. Also the costs of Shopify, the domain and the apps, which the Client pays.

6.3. Client content. Texts, photographs, videos, logos and data the Client did not provide, provided late or incomplete, or has no right to use. Product photography and catalog writing are not included.

6.4. Business results. Sales, conversion, traffic, search-engine ranking, advertising and the performance metrics of a third party.

6.5. Changes by others. What the Client or a third party modifies in the Theme, in its settings or in its apps after delivery.

6.6. Other services. What section 1 leaves outside the Guarantee, including recurring optimization.

When something is excluded, Digitdeck says so in writing and offers to quote it before starting.

7. Term, how to request it and relation to the Quote

7.1. Term. The Guarantee runs from the moment the Client accepts the Quote until Acceptance, express or by silence.

7.2. After Acceptance. For 30 calendar days from Acceptance, the Client may report a failure to meet the Criteria that already existed in the accepted Theme. Digitdeck corrects it at no additional charge, except what is excluded in section 6.

7.3. How to request it. The Client writes by WhatsApp to +57 305 253 8744 or by email to digitdeck.servicios@gmail.com. It states the name of the Project and of the store, the Criterion that is not met, where it can be seen (the preview theme link and the device or width) and, if possible, a screenshot. Digitdeck confirms receipt in writing.

7.4. Relation to the Quote. The Quote or the signed contract prevails on what is specific to the Project: the pages, templates, features, price and schedule. In everything else this policy governs.

7.5. Applicable version. Each Project is subject to the version of this policy in force when the Client accepted the Quote. Digitdeck may update it for future Projects.

7.6. Governing law. The laws of the Republic of Colombia govern.
